In a lawsuit filed in U.S. District Court in Rochester, Red Bull alleges that bar magnate Ronnie Davis and several taverns he operates — Soho East, Daisy Dukes and Coyote Joe’s — serve Mad Croc to customers who order cocktails made with Red Bull.
Red Bull claims the practice, called “passing off” in the restaurant trade, hurts its trademark, deceives the public and creates unfair competition by allowing the bars to profit by substituting a lower-priced product.
The company alleges that Davis has ignored demands to stop the practice and asks for an injunction to prevent it.
Davis said the legal action is a cost of doing business.
“Frivolous lawsuits are an ongoing thing in my business and it’s just part of the day-to-day operations,” he said. “In my mind, it’s a joke.”
